Las infracciones y sanciones administrativas forestales del Código Orgánico del Ambiente

Abstract

Las infracciones y sanciones administrativas forestales previstas en el Código Orgánico del Ambiente vulneran el principio de proporcionalidad, por ende, se estudiará la descripción y análisis sistematizado del Código Orgánico del Ambiente ya que posee preceptos y garantías que buscan la protección del medio ambiente, pero las sanciones afectan a las personas naturales. El Ecuador posee una gran diversidad de flora y fauna; sin embargo, el aprovechamiento irracional con la explotación de los recursos naturales renovables y no renovables tienen como efecto amenazas a la biodiversidad y al ecosistema, debido a la creciente explotación forestal. Por consiguiente, consiste en revisar la normativa constitucional, administrativa ambiental y cuatro procesos administrativos forestales del Cantón Cayambe del año 2018

The administrative forest violations and sanctions provided for in the Organic Code of the Environment violate the principle of proportionality. In consequence, this study will seek to systematically describe and analyze the Organic Code of the Environment, since it contemplates precepts and guarantees that seek to protect the environment, but the sanctions provided therein affect natural persons. Further, it is worth noting that Ecuador possesses great floral and faunal diversity; however, the irrational exploitation of renewable and non-renewable natural resources threatens this biodiversity and Ecuadorian ecosystems, as is seen in the growing field of forest exploitation. Therefore, it is pertinent to review constitutional, administrative and environmental regulations, as well as four administrative procedures regarding forest exploitation, in the canton of Cayambe, in the year 2018
